Contractor Compliance Overview

The Civil Rights Section, through implementation of its Contract Compliance Program maintains the commitment to insuring highway construction and non-construction firms are adhering to the EEO and EO contractual obligations and federal regulatory provisions, insuring that all activities and operations are conducted in a non-discriminatory fashion and insuring equal opportunities for minorities and women.

Revised form FHWA-1273

On June 25, 2012, through the Federal Register, Notices, Vol. 77, No. 122, the Federal Highway Administration (FHWA) announced the new Form 1273, which was revised May 1, 2012.

Prompt Payment Requirements

The Civil Rights Section has the responsibility of monitoring payments to DBE firms submitted to meet goals on a contract. The prime contractor is required to submit proof of payments to DBE firms along with all other subcontractors and suppliers on a monthly basis. The link below will provide you with the legislation regarding payment requirements. Specifically Title 17- Highways, Chapter 8- Highway Construction Payments, Sections 801 to 805. www.delcode.delaware.gov/title17/c008/index.shtml 


Contractors' Compliance Responsibilities Include:

  • Knowing and complying with all of the provisions of Form 1273 and including that mandatory language in all of their subcontracts
  • Developing and utilizing relationships with recruitment sources intended to increase minority and female representation in their workforce

Required Bulletin Board Postings

Some of the statutes and regulations enforced by agencies within the Department of Labor require that posters or notices be posted in the workplace. The Department provides electronic copies of the required posters and some of the posters are available in languages other than English.
